Minnesotta DWI / DUI Overview

Minnesota DWI laws provide for up to 90 days in jail and fines, DWI alcohol education, license restrictions and more. If aggravating circumstances exist as defined by Minnesota law, the law provides for up to one year in jail and a fine of up to $3,000.

A second Minnesta DWI offense within 10 years of a prior offense is considered a gross misdemeanor and provides for up to one year in jail plus a fine up to $3,000.

A third offense within 10 years results in the immediate impoundment of your vehicle and increased likeliness of jail.

A fourth offense within 10 years is a felony which can mean up to three years in jail and a fine not less than $14,000.

Degrees

Minnesota DWI / DUI laws include various "degrees" which relate to the seriousness of the charge. The degrees provide for the seriousness of the circumstances surrounding the offense.
  • First DWI or Implied Consent license revocation in past ten years: Misdemeanor Fourth Degree DWI;
  • Second DWI offense or Implied Consent license revocation in past ten years: Gross Misdemeanor Third Degree DWI;
  • Third DWI offense or Implied Consent license revocation in past ten years: Gross Misdemeanor Second Degree DWI;
  • Fourth or more DWI or Implied Consent license revocation in past ten years: Felony First Degree DWI;
